Blood Tests in New Jersey DWI Cases
In most driving while intoxicated cases, the driver will be given the Alcotest 7110 breath testing device to indicate how much alcohol he or she has consumed. However, in some cases, the driver will instead be required to take a blood test to show the level of intoxication. This usually happens when there is an accident and the driver is sent to the hospital for treatment. Other situations where a blood test is usually given include if a driver is injured and is in need of medical attention or because the defendant’s injury prevents him from providing a breath sample, a defendant’s blood alcohol content (BAC) is dangerously high, or a defendant’s blood alcohol content (BAC) is dangerously low.
Note: There may be ways to challenge the blood sample in your case. For example, there could be an issue with the chain of custody or a problem with the way the blood test was obtained, or the person who took the sample might not have been medically authorized to do so.
Refusal to submit to a blood test is not a valid charge in New Jersey like refusal to submit to a breath test is. The police however, are allowed to take a blood test from a person without their permission depending on the circumstances in which case you do not have the right to refuse.
