Forfeiture of Weapons in New Jersey 

This forfeiture of weapons provision (Domestic Violence Act) authorizes the state to confiscate a person’s weapon, generally in domestic violence cases where a restraining order has been issued. The state does not have to meet a burden of proof to file a forfeiture of weapons motion and it is therefore up to you to show why the weapon should be returned. Along with the right to take your weapon, the police also can confiscate your firearm purchaser identification card and your firearm purchasing permit.

Pursuant to the Domestic Violence Act, a defendant may be exposed to the following consequences:

  1. Search of the defendant’s residence for weapons, a warrant is not required.
  2. Seizure of any weapons discovered in the residence.
  3. Forfeiture of weapons at the end of the domestic violence proceedings

Note: If the case is dismissed, the weapon will be returned if the court decides that permanent forfeiture would not serve the best interests of public safety.
