New Jersey Embezzlement Statute: N.J.S.A. 2C:20-3
New Jersey’s embezzlement statute, N.J.S.A. 2C:20-3, makes it illegal for someone who is temporary lawful possession of someones property to fraudulently converting it to his or her own use.
Penalties and Grading for embezzlement are as follows.
Second Degree – When the amount embezzled is at least $75,000
- 5 to 10 years in New Jersey State Prison
- Fine of up to $150,000 or double the amount that was embezzled, whichever is more.
Third Degree – When the amount embezzled is between $500 and $75,000.
- 3 to 5 years in NJ State Prison
- Maximum $15,000 fine
Fourth Degree – When the amount embezzled is between $200 and $500
- Up to 18 months in NJ State Prison
- Maximum $10,000 fine
Disorderly Persons Offense – When the amount embezzled is less than $200
- Up to 6 months in county jail
- Maximum $1,000 fine
