In New Jersey, robbery occurs when a person uses force or threats during theft or attempted theft. Robbery is usually a second degree crime, however, since the suspects in this case were armed, the charge can be upgraded to a first degree crime which are the most serious in New Jersey. A first degree crime carries a prison sentence of 10 to 20 years in New Jersey State Prison. Also, robbery is included under the “No Early Release Act” which means that 85 percent of the sentence must be served before parole eligibility.
