New Jersey Credit Card Fraud Statute: N.J.S.A. 2C:21-6h
N.J.S.A. 2C:21-6h is New Jersey’s credit card fraud statute. It provides:
A person who knowingly uses any counterfeit, fictitious, altered, forged, lost, stolen or fraudulently obtained credit card to obtain money, goods or services, or anything else of value; or who, with unlawful or fraudulent intent, furnishes, acquires, or uses any actual or fictitious credit card, whether alone or together with names of credit cardholders, or other information pertaining to a credit card account in any form, is guilty of a crime of the third degree.
Credit card fraud is a third degree crime in new Jersey and can result in 3-5 years in New Jersey State Prison. These cases must be handled in the Superior Court in the county where the offense was committed.
Note: Just because you have been charged with credit card theft does not mean you cannot also be charged with credit card fraud. A person could be charged with credit card theft for having possession of a stolen credit credit card and charged for credit card fraud for using that card.
Note: If you have no prior record, you may avoid going to jail for this offense and instead receive probation or admission into the Pre-Trial Intervention Program (PTI).
