New Jersey DWI in a School Zone
Under N.J.S.A. 39:4-50(g), a DWI in a school zone occurs when you get a DWI:
(1) on any school property used for school purposes which is owned by or leased to any elementary or secondary school or school board, or within 1,000 feet of such school property;
(2) driving through a school crossing as defined in R.S.39:1-1 if the municipality, by ordinance or resolution, has designated the school crossing as such; or
(3) driving through a school crossing as defined in R.S.39:1-1 knowing that juveniles are present if the municipality has not designated the school crossing as such by ordinance or resolution.
DWI in a School Zone Penalties in New Jersey
The penalties for a DWI in a school zone vary depending on if it is a first, second, or third offense:
First Offense
- 1 to 2 year license suspension
- Maximum of 60 days in jail
- Intoxicated Driver Resource Center (IDRC): 12 to 48 hours
- Fine between $500 and $800
- If BAC was below .15%, possibility of ignition interlock device. If BAC was over .15%, mandatory ignition interlock device between 6 months and 1 year
Second Offense
- License suspended for 4 years
- Jail sentence between 4 and 180 days. However, 90 of these can be served by doing community service
- IDRC
- Fine between $1,000 and $2,000
- Ignition interlock device for 1 to 3 years
Note: For these penalties to apply, the first offense must have committed in a school zone
Third Offense
- License suspended for 20 years
- Jail sentence of 180 days, 90 of which can be served through community service
- $2,000 fine
- IDRC
- Ignition interlock device for 1 to 3 years
