Forfeiture of Weapons
Forfeiture of Weapons

Since gun laws in New Jersey have become more strict in part due to programs such as the Targeted Anti-Gun Initiative, being convicted of a weapons offense can expose you to several life changing consequences including forfeiture of your firearms and the right to own a firearm in New Jersey in the future. You may also receive a lengthy prison sentence, many times without an opportunity for parole. If you have been charged with a weapons offense in New Jersey, you will need a knowledgeable and experienced criminal defense attorney to help you minimize the penalties and get the most desirable outcome in your case.

The attorneys at the Law Offices of Leonard Biddison have had tremendous success handling weapons offenses for years in Camden County including Lindenwold, Cherry Hill, Gloucester, and Pine Hill. In fact one of the members of our criminal defense team is a former county prosecutor in New Jersey who used to prosecute various charges for the State including gun and weapons offenses. This means we can predict what kinds of arguments the prosecution will make and use this knowledge to defend your case. Also, another one of our attorneys has had excellent success in getting the penalties for weapons offenses reduced to probationary sentences rather than jail time. If you have been charges with a weapons offense, having an attorney who knows what it takes to potentially beat the charges against you is imperative. Call the Law Offices of Leonard Biddison at 877-450-8301 anytime for a free initial consultation.

Forfeiture of Weapons in New Jersey

This forfeiture of weapons provision (Domestic Violence Act) authorizes the state to confiscate a person’s weapon, generally in domestic violence cases where a restraining order has been issued. The state does not have to meet a burden of proof to file a forfeiture of weapons motion and it is therefore up to you to show why the weapon should be returned. Along with the right to take your weapon, the police also can confiscate your firearm purchaser identification card and your firearm purchasing permit.

Pursuant to the Domestic Violence Act, a defendant may be exposed to the following consequences:

  1. Search of the defendant’s residence for weapons, a warrant is not required.
  2. Seizure of any weapons discovered in the residence.
  3. Forfeiture of weapons at the end of the domestic violence proceedings

Note: If the case is dismissed, the weapon will be returned if the court decides that permanent forfeiture would not serve the best interests of public safety.
