A woman from Mount Holly has been charged with death by auto.
The charges are related to an incident that took place last month when the woman, Andrea Rodriguez-Pazmino, ran a red light on Route 541 and crashed into an SUV, killing a 9 year passenger. As a result of the collision, the SUV rolled onto its roof and crashed into another vehicle as well. Rodriguez-Pazmino and the other passengers in the SUV only suffered minor injuries.
Death by auto is usually considered a second degree crime although it can be first degree in some circumstances. If Rodriguez-Pazmino is charged and convicted in the second degree, she will face a 5 to 10 year New Jersey State Prison Sentence with a presumption of incarceration. A first degree conviction would result in 10 to 20 years in NJ State Prison. Further, 85 percent of the sentence for this crime in either degree must be served before the defendant is eligible for parole.
