Megan’s Law Sex Offender Registration in New Jersey
In New Jersey, if a person is convicted of a sex crime, he or she is required to register their address with the police station and keep them updated with any changes in address, schooling, and employment as explained under N.J.S.A. 2C:7-1 to 21. You must register if you are found not guilty by reason of insanity, any adjudicated delinquent, or if you are found guilty of one of the following crimes:
- Luring or Enticing a Minor
- Criminal Sexual Contact (if the victim is under the age of 18)
- Kidnapping (if the victim is under 18 and the offender is not the parent)
- Criminal Restraint (if the victim is under 18 and the offender is not the parent)
- False Imprisonment (if the victim is under 18 and the offender is not the parent)
- Aggravated Sexual Assault
- Sexual Assault
- Aggravated Criminal Sexual Contact
- Endangering the Welfare of a Minor by Engaging in Sexual Contact with a Minor
Removal From Megan’s Law in New Jersey
Although the consequences of Megan’s Law can be severe, the drafters of the law did provide a way to potentially be removed from the registry for those who fulfill certain requirements as explained below:
- 15 years have passed since the conviction or release from prison (whichever is later);
- The conviction was not for any offense listed in section g of the statute;
- The registrant has not had any convictions in the 15 years since the original conviction; and
- The registrant is “not likely to pose a threat to the safety of others.”
