Obtaining CDS by Fraud in New Jersey 

The law for obtaining a CDS by fraud is explained under N.J.S.A. 2C:35-13. It provides:

It shall be unlawful for any person to acquire or obtain possession of a controlled dangerous substance or controlled substance analog by misrepresentation, fraud, forgery, deception, or subterfuge. A violation of this section shall be a crime of the third degree.

Note: Possession under the statute means knowing and intentional control of a designated thing, accompanied by a knowledge of its character as contraband. Since the prosecution must prove knowledge, there might be defenses available in your case pertaining to this element. 

Penalties – As the statute above explains, obtaining a CDS by fraud is third degree crime in New Jersey. Penalties include:

  • New Jersey State Prison sentence of 3 to 5 years
  • $1,000 payment to the Drug Enforcement Demand Reduction
  • $50 lab fee
  • Possible $50,000 fine

Note: Since this is a third degree crime, there is a presumption of non-incarceration for first time offenders. This means you might be eligible for a probationary sentence such as the Pre-Trial Intervention Program. Successful completion of this program will result in the charges against you being dropped.
